A. Not For Emergencies

THIS SERVICE IS NOT FOR MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY. DO NOT RELY ON OUR WEBSITE OR AI TOOLS FOR URGENT MEDICAL NEEDS.

A doctor-patient relationship with HJME or its providers is only established when:

• •You have successfully completed the intake process;
• •You have signed our specialized Patient Consents (provided separately); AND
• •A provider has reviewed your information and agreed to undertake your care.

By using our Services, you consent to receive medical care via telehealth technologies. You acknowledge that:

• •Telehealth involves the delivery of healthcare using electronic communications (video, audio, text).
• •There are potential risks to telehealth, including technical failures, interruptions, or unauthorized access to data.
• •A physical exam may still be required in some cases, which we cannot provide virtually. If your condition requires an in-person exam, we will refer you to a local provider.

You agree to:

• •Provide accurate, current, and complete information during the intake process.
• •Do not lie to the AI. Providing false clinical information can lead to misdiagnosis or injury. We are not liable for adverse outcomes resulting from false or incomplete information you provide.
• •Use the Services only for lawful purposes and in accordance with these Terms.

Your use of the Services is also governed by our Privacy Policy and Notice of Privacy Practices. By using the Services, you consent to the data practices described in those documents.

• •Payment Due: Payment for services is due at the time of service unless otherwise agreed in writing or covered by an accepted insurance plan.
• •No Refunds: Generally, fees paid for medical consultations are for the provider's time and are non-refundable, regardless of the medical outcome or diagnosis.
• •Insurance: If we bill insurance on your behalf, you are responsible for any co-pays, deductibles, or non-covered services.

TO THE FULLEST EXTENT PERMITTED BY LAW, HJME MEDICAL VUC, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, RESULTING FROM:

• •Your use or inability to use the Services;
• •Any errors or inaccuracies in the AI chatbot's responses;
• •Unauthorized access to or use of our servers and/or any personal information stored therein.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

These Terms shall be governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Oklahoma City, Oklahoma.

We reserve the right to modify these Terms at any time. Your continued use of the Services after any such change constitutes your acceptance of the new Terms.
